The Immigration and Nationality Act provides several categories of nonimmigrant visas for a
person who wishes to work temporarily in the United States, including the following visas:
H1B Visa
The H-1B visa is the visa set aside for
"professionals". According to federal regulations the
position to be filled by the foreign worker must require the services
of a professional, and obviously, the foreign worker must qualify as a
professional.
TN Visa
The TN visa or Treaty National visa is the
professional visa that exists for Canadian and Mexican professionals
pursuant to the North American Free Trade Agreement (NAFTA).
O Visa
The O visa is set aside for aliens of
"extraordinary" ability in the sciences, arts, education,
business or athletics, certain aliens accompanying or assisting those
aliens, and their family members.
P Visa
The P visa category is for those entertainers and
athletes who cannot qualify under the extraordinary ability standard
of the O category.
